Glossary:
Store – the online store operating at https://www.moto-parts.eu/ selling goods via the Internet;
Business days – all days from Monday to Friday, excluding public holidays;
I. Order Placement and Fulfilment.
1. The Store sells goods and services within Poland via the Internet. Information about the goods and services is published on the moto-parts.eu website.
2. A Customer of the Store can be a natural person with full or limited legal capacity, a legal person, or an organizational unit without legal personality.
3. Orders from Customers are accepted via the moto-parts.eu website 7 days a week, 24 hours a day. Orders are fulfilled on working days during the Store's business hours.
4. To make purchases in the Store, an active email account is required. To place an order, the Customer must go to moto-parts.eu, fill out the form, and accept the Terms and Conditions or register a Customer Account.
5. Advertisements, price lists, and other information on the website are not offers within the meaning of Article 66 of the Civil Code but are only invitations to conclude a contract. The Seller reserves the right to change prices of goods or services.
6. By submitting an order to the Store, the Customer makes an offer to conclude a sales contract. The Customer receives an email asking to confirm the order. Once confirmed and accepted by the Store, the order is fulfilled.
7. To place an order, the Customer must:
– select the goods or services,
– choose the delivery method and provide the shipping and billing addresses (these may differ),
– choose the payment method.
8. If the ordered goods are unavailable in the Store’s warehouse or from suppliers, or if the order cannot be fulfilled for other reasons, the Store will inform the Customer within 30 (thirty) days from the date of the contract and will refund any payments. The notice will be sent to the Customer's email address.
9. If only part of the order is unavailable, the Customer will be informed of the order status and may choose how to proceed.
10. The Customer may choose:
– partial fulfillment – only available goods will be delivered; the Store is released from supplying unavailable items,
– canceling the entire order – the Store is released from fulfilling it and will refund payments if made.
11. Promotional and clearance sales have limited quantities.
12. Orders are fulfilled in the order they are confirmed, until stocks are exhausted.
II. Order Modifications.
1. The customer may make changes to the order or cancel it until the order is handed over for shipment. Changes can be made by contacting the Customer Service Office via the contact form on the help pages or by phone.
2. Changes submitted by other means than via the contact form will only be made after verifying the customer's identity.
3. Modifications related to: customer's address, delivery address, and refund instructions will be accepted only via the contact form.
III. Product Prices.
1. All product prices listed on the Store’s website:
– are given in Polish zloty,
– include VAT,
– do not include any potential customs duties,
– do not include delivery costs.
2. The price listed with each product is binding at the time of the Customer's order confirmation and acceptance by the Store.
3. The Store reserves the right to conduct and cancel promotional campaigns and sales or to modify them. This right does not affect product prices in orders placed before the effective date of such changes.
4. Promotions in the Store cannot be combined unless otherwise stated in the promotion’s terms.
5. Delivery is carried out in the manner selected by the Customer and specified in the order. The current delivery cost table is available on the Store’s website.
IV. Order Fulfillment Time.
1. Each product includes an estimated preparation time for shipping. This is the time from accepting the order for processing to handing the package over to the carrier. Only business days are counted. Orders containing products with different processing times are shipped once the entire order is complete. The shipping time is based on the item with the longest preparation time.
2. Within Poland, delivery can be made, at the Customer’s choice:
– via courier service,
3. For selected products, the Store reserves the right to exclude certain delivery options.
4. Upon delivery, the Customer should inspect the shipment in the presence of the courier.
5. In the case of damage or tampering with the packaging, a damage report should be drawn up in the presence of the courier. Sending this report with the complaint to the Store will facilitate its processing.
V. Payment Methods. Order Processing Start.
1. The Customer may choose the following payment methods for orders with delivery within Poland:
– bank transfer,
2. Order processing begins after the order process is completed.
3. Order processing begins once the Store receives confirmation of successful payment from the payment operator, or in the case of a bank transfer – after the payment is credited to the Store’s account.
4. For selected products, the Store reserves the right to exclude certain payment methods.
VI. Complaints.
1. The goods may be covered by a manufacturer’s or distributor’s warranty. Detailed warranty terms and duration are provided in the warranty card issued by the guarantor.
2. If the received product is defective, the Customer may, at their discretion, exercise warranty rights directly with the guarantor (manufacturer or distributor) at the designated service centers, or exercise their rights against the seller under the non-conformity of the goods with the contract. Warranty rights and rights arising from non-conformity are independent of each other.
3. In case of non-conformity of the goods with the contract, the Customer has the right to file a complaint with the Store. This right is valid for 2 (two) years from the delivery date, provided the Store is notified of the non-conformity within 2 (two) months of its discovery. In such case, the Customer should return the goods to the Store’s address.
4. A proof of purchase and a description of the complaint (template available on the store’s website) must be attached to the returned goods.
5. The Store will respond to the complaint and inform the Customer about further steps without delay, but no later than within 14 days of receiving the returned goods.
6. If the complaint is accepted, the damaged goods will be repaired or replaced with a new, fault-free product. If that is not possible, the Store will refund the Customer the value of the goods. Return shipping costs will be reimbursed after the complaint is approved.
VII. Withdrawal from the contract.
1. In accordance with the Act of March 2, 2000 "On the protection of certain consumer rights and liability for damage caused by a dangerous product", a Customer who is a natural person making a purchase for purposes not related to professional or business activity may withdraw from the contract without giving any reason within 14 days from the date of receiving the shipment.
2. The Customer should submit a statement of withdrawal and return the goods to the Store.
3. Returned goods must be complete. Goods should be returned in an unchanged state unless the change was necessary within the limits of ordinary management, i.e., the Customer should handle the goods with the possible return in mind.
4. The returned goods must be sent back no later than 14 days from the withdrawal from the contract, together with the withdrawal statement (template available on the Store's website).
5. The cost of returning the goods is non-refundable.
6. The Store will refund the amount due for the returned goods within 7 (seven) business days.
VIII. Refunds to Customers. Overpayments.
1. If circumstances arise that oblige the Store to refund amounts paid by the Customer to the Store’s account, the refund shall be made within a maximum of 7 business days.
2. If the Customer made the payment by bank transfer, the refund will be made to the bank account from which the payment was made or to another account indicated by the Customer.
Personal Data.
1. By placing an order in the Store, the Customer agrees to the inclusion of their personal data in the database of AUTOMOBILE GMBH SP. Z O.O., ul. Grunwaldzka 7, 08-110 Siedlce; and to the processing of such data for the purpose of fulfilling the order. Providing personal data is voluntary; however, lack of consent to data processing makes it impossible for the Store to complete the order. The Customer is responsible for providing false personal data.
2. Personal data is protected in accordance with the Personal Data Protection Act of 29.08.1997 (i.e., Journal of Laws No. 101 of 2002, item 926, as amended) in a manner preventing access by third parties.
3. If the Customer gives additional consent, personal data will be processed by the Store for the purpose of informing the Customer about new products, promotions, and services available in the Store.
4. Store Customers have the right to access their personal data, correct it, and request its deletion.
Final Provisions.
1. The sales agreement is concluded between the Customer and AUTOMOBILE GMBH SP. Z O.O., ul. Grunwaldzka 7, 08-110 Siedlce.
2. The products presented on the Store’s website do not constitute an offer within the meaning of the Civil Code. Information about products does not imply that they are available in the Store’s warehouse or with its suppliers.
3. The Store is not responsible for email messages being blocked by mail server administrators or deleted/blocked by software on the Customer’s device.
4. The Store is not liable for errors in order handling or other Customer instructions caused by incorrect data provided by the Customer.
5. The Store uses cookies to analyze user behavior on the moto-parts.eu website.
6. The Customer may use the website without cookies, but this may affect the functionality or availability of some features. If the Customer does not agree to the use of cookies, they should set their browser to block cookies or alert on cookie transmission.
7. Any disputes between the Customer and the Store shall be settled by the competent court in accordance with the Civil Procedure Code of November 17, 1964 (Journal of Laws No. 43, item 296, as amended).
8. In matters not regulated by these Terms, the provisions of Polish law shall apply, in particular the Civil Code, the Act on Special Conditions of Consumer Sales and amending the Civil Code (Journal of Laws No. 141/2002, item 1176, as amended), and the Act on the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product (Journal of Laws No. 22/2000, item 271, as amended).
9. These Terms are effective from January 1, 2014.
10. The Store reserves the right to amend the Terms. Any amendments will take effect no earlier than 7 days after being published on moto-parts.eu.
Orders placed before the effective date of changes to these Terms and Conditions shall be processed according to the provisions in force on the date the order was placed.
Order Processing Time – the time in which the Store completes the order and hands it over to the carrier selected by the Customer;
Customer – a natural person or company making purchases in the Store;
Consultant – a person providing customer service;
Customer Account – a database containing Customer data used for order processing, order history, preferences related to selected Store functionalities, and data on payments and overpayments for orders;
Traditional Bank Transfer – a payment made by the Customer via an online or in-person bank account or at the post office;
Electronic Bank Transfer – a payment made by the Customer from an online bank account via the Przelewy24 online payment system;
